Note

A will versus a declaration of heirs

They are different acts. A will directs the estate during the testator’s life. A declaration of heirs identifies who succeeds when the estate must be opened.

Outline

  1. The will

It is granted by a person with capacity, before a notary, with the formalities the law requires. This note does not supply a form.

  2. Declaration of heirs

It is used to identify those called to the inheritance. It depends on that family’s facts.

  3. Partition

A partition before a notary is a separate act. It is scheduled only when the file allows it.
